Open Letter:
The Concerned Residents of Heritage El Dorado Hills Village (CRHV) and the El Dorado Hills Community Services District (CSD) have executed a settlement agreement on the litigation over Heritage Park Case No. 22CV0640. Pending approval from the El Dorado County Superior Court, this agreement concludes the three-year litigation. CRHV sued EDH CSD to compel adherence to safety and building codes and the Carson Creek Specific Plan, removal of unauthorized and illegal “amenities” (like 50 ft stadium lights), andmitigation of nuisance noise and trespass. CSD operated Heritage Park without permits. In signing the agreement, CSD admits no wrongdoing.
The terms of the settlement agreement include:
• CSD will immediately disable the sports court and parking lights and remove them within 24 months
• CSD will set Park operating hours from dawn to dusk when no lighting is needed
• CSD will remove a pavilion, benches & barbecues on the north side of the park
• CSD will install trees and shrubs to reduce sound
• CSD will remove noise-making playground equipment
• CSD will work with HOA to mitigate illegal parking and trespass into Heritage Village
• El Dorado Superior Court is empowered to effectuate any necessary actions to enforce this settlement agreement, including costs of “compliance.”
• CSD will pay CRHV counsel $70,000 for recovery of legal fees and costs
• CSD may seek permits to install one parking lot light and other lights only if they conform to ordinances, codes, and the Carson Creek Specific Plan
• CRHV dismissed Superior Court Case #22CV0640 without prejudice and retains the Court’s jurisdiction until performance in full of the terms of the settlement.
CRHV extends our gratitude to the Heritage community for years of support. Hundreds of Heritage residents contributed hard-earned dollars and countless hours of time. THANK YOU FOR THOSE CONTRIBUTIONS!!!! Additionally, our legal team deserves appreciation for dedicated service that was above and beyond: Chief attorney Jim Brunello, senior land- use consultant Cindy Shafer, and associate counsel Karen Pine. Finally, CRHV recognizes the efforts of both the CSD Interim General Manager Stephanie Jantzen and some members of the CSD Board in helping to end this contentious Heritage Park dispute.
We will remain diligent until the terms of the settlement have been fulfilled. The years of
effort will not be forgotten. Our friends and neighbors testified at many CSD meetings only to be disrespected and mocked by Board members with defiant taunts to “light them (stadium lights) up.” We witnessed our free speech suppressed as a peaceful banner to “Take Down The Lights” was seized and torn down by the ex-General Manager while the Board and Counsel watched. That history of abuse cannot be erased. Today, we celebrate the Heritage Park settlement … but we will move forward with due caution.
Heritage Park settlement is positive news, yet other serious issues remain unresolved. For example, more information regarding our efforts to enforce Measure S will be covered in a separate letter.
